Saigon Central Post, Inc. dba Hoa Phat Agreement

Thank you for choosing Saigon Central Post, Inc. dba Hoa Phat (referred interchangeably in this contract as “Hoa Phat,” “Company,” “Saigon Central Post, Inc.,” or “SCPI Hoa Phat”) where we strive to connect the Vietnamese communities in the United States of America with their loved ones in Vietnam.

This User Agreement (“Agreement”) describes the terms and conditions that apply to your use of:

• the website located at www.scpihoaphat.com (and subdomains),
• mobile application (“SCPI Hoa Phat,” “Hoa Phat”), and
• the services (“Service”).

This Agreement applies to United States Hoa Phat Accounts only.

By using this Mobile App and our Service, you agree to and accept this User Agreement. If you do not agree, do not use the Service.

Overview of the Service

The Service allows registered users (18 years or older and legally capable of forming a contract) to send money to recipients in Vietnam.

• Transactions are limited to Hoa Phat locations listed in this agreement.
• Mobile app transactions must occur in licensed states.
• Users should only send money to people they know personally.
• Do not send money to strangers (see fraud/scam warnings).

Supported states:

• California
• Florida
• Georgia
• Louisiana
• Maryland
• Texas

Collection of Information

To use the Service, you must:

• Register an account at physical locations or via the mobile app
• Accept the Privacy Policy

The Service Definitions

• Sender: person sending money
• Recipient: person receiving money
• Transaction: instruction to send money
• Net Amount: USD amount sent to recipient

Service Cost

Transmission Fee

• Sender must pay a fee in addition to the Net Amount
• Fees may vary depending on payout method and other factors
• Total amount must be paid upfront in USD

Transfer Taxes

Additional fees may apply depending on regulations (OBBBA).

Foreign Currency Exchange

• Exchange rates are applied to transactions
• Any profit from exchange rate differences is kept by Hoa Phat
• Rates are disclosed before transaction confirmation

Third-Party Charges

You are responsible for:

• Bank fees
• Debit card charges
• NSF (insufficient funds) fees
• Chargebacks

Hoa Phat is not responsible for these costs.

Right to Refund

• Refunds go back to the original payment method
• Refunds are in USD only
• No adjustment for exchange rate changes

Refund conditions:

• Must submit a written request
• If payout not completed, transaction is cancelled and refunded
• No liability if incorrect bank account info is provided

California-Specific Rules

• Recipient may receive less due to bank fees/taxes
• Error dispute must be reported within 180 days

Cancellation: Full refund allowed within 30 minutes (if not yet paid out).

• Consumer Financial Protection Bureau
• California Department of Business Oversight

Refund Guarantee

You are entitled to a refund if:

• Money is not sent within 10 days
• Instructions are not followed

Possible compensation: up to $1,000 penalty plus legal fees (per California law).

Disputes & Arbitration

• Governed by California law
• Disputes resolved via binding arbitration
• Must use agreed dispute resolution provider
• Improper claims may result in legal cost recovery

Termination

• Agreement starts upon acceptance
• User can terminate anytime via phone: 1 (866) 531-6363
• Company can terminate anytime
• Illegal use may result in suspension or legal action
